2009 Legislative InformationThe following are bills that passed in the 2009 legislative session that are relative to property assessments. HB0138 - Provides amendments to the property tax refund program.
http://legisweb.state.wy.us/2009/Enroll/HB0138.pdf HB0221 - An act that relates to a property owner being able to provide credible evidence during the property protest procedure to rebut the valuation placed on a property by the County Assessor. http://legisweb.state.wy.us/2009/Enroll/HB0221.pdf HB0279 - An act relating to the release of the Statements of Consideration (an otherwise confidential document) during a property review/protest. This act enhances a procedure that was already allowed and being followed by County Assessors. http://legisweb.state.wy.us/2009/Enroll/HB0279.pdf SF0144 - An act relating to rules and regulations for the assessment of property. There are already rules and regulations in place for County Assessors. Every year the County Assessor has a hearing with the State Board of Equalization (SBOE) to determine if the county is in compliance with the SBOE rules and regulations. The county values for property tax purposes on the mass appraisal process have to be within a median of 95-105 of the sold properties. The values have to have a Coefficient of Dispersion (a measure of relative variability and a widely used measure of appraisal uniformity) of 15 or less for residential improved property and 20 or less for residential vacant property. The values also have to have a Price Related Differential (relates to the equality in the appraisal of low and high value properties) of 98-103. Anything above 1.00 suggests that high-value properties are being under appraised and under 1.00 suggests that high value properties are over appraised. These statistics are all within the guidelines of the International Association of Assessing Officers (IAAO) with the exception of the median. IAAO standard is between 90-100 and the State of Wyoming is more stringent at 95-105. The County Assessor already provides the SBOE with the statistical parameter data. The primary portion of this bill that will be a new procedure is preparing the written documentation and creating a computer generated report showing the actual calculation of value. http://legisweb.state.wy.us/2009/Enroll/SF0144.pdf HB0009 - An act providing for allowing a tract, unit or parcel 35 acres or more that is within a platted subdivision to receive the agricultural classification as long as it otherwise qualifies. http://legisweb.state.wy.us/2009/Enroll/HB0009.pdf
